Yes, you may now e-File until 11:59:59 ET and your documents will be file stamped the same day if the clerk accepts your filing. File & ServeXpress captures the time and date immediately when you submit your filing successfully. Upon acceptance by the court clerk, a time and date stamp watermark will appear in the upper right-hand corner of your lead document. This will be the time and date of your submission. If the clerk rejects the filing, you must take corrective action and resubmit your entire filing. A rejected filing is not docketed by the court's case management system.
When you successfully submit your filing, you'll receive an instant receipt with a date and time stamp and information about your filing. You will also receive an acknowledgement email upon submission if the court clerk reviews accepts your filing, you will receive a confirmation email and an electronic file stamped copy will be available from your Dashboard.
The filing attorney and the delegate who files on his/her behalf will receive an acknowledgement email when the document is submitted, and a confirmation email when the document is accepted by the clerk, or an alert email when the filing is rejected by the clerk. All notification emails will provide the trace number for the filing.
e-Service is mandatory for the D.C. Superior Court and enables attorneys to electronically serve opposing parties and the judge when e-Filing their case documents to the court. If pro se parties elect to e-File they may be e-Served. Otherwise, pro se parties must be served outside of the File & ServeXpress e-Filing system through traditional methods such as mail, fax, or hand delivery.
The filer and the attorney of record sending the service will receive a proof of service email with an attached PDF document with details of the e-Service.
The cost to e-File and e-Serve into the D.C. Superior Court is $15 per filing submission.
The total cost for discovery service is $8.50 regardless of the number of attorneys served, up to 30 MB per transmission.
e-Filing fees are calculated by adding the court filing fee (if applicable) + the File & ServeXpress e-Filing fee ($15.00) + a (3% + $1) processing fee to NIC (the service that remits court and filing fees to the D.C. Superior Court and File & ServeXpress). In the near future NIC will offer a cash discount for electronic check payments.
